OVERVIEW
Welcome to Tu Invite! The terms “we”, “us” and “our” refer to Tu Invite. Tu Invite operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Tu Invite is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”) together with any policies referenced herein describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy . If you do not agree, do not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence, and you consent to allow any of your minor dependents to use the Services on devices you own or manage.
To use the Services, you may be asked to provide contact, billing, and payment information. You represent that all information you provide is correct, current, and complete and that you have the rights to provide it.
You are responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account.
SECTION 2 – OUR PRODUCTS (DIGITAL CONTENT)
We sell digital products (including templates, downloadable files, and bundles). We strive to describe them accurately; however, colors/appearance may vary by device and settings.
Unless expressly stated otherwise on a product page, all products are digital and do not include physical items. Features, inclusions, and compatibility requirements (e.g., Canva, fonts, software) are listed on each product page and may change without notice. We may discontinue or limit products at our discretion.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted when payment is processed and you receive confirmation. Review your order carefully; cancellations may not be possible after acceptance.
Your purchases are subject to our Refund Policy. For clarity, digital items are non-returnable and non-refundable once downloaded/accessed, except where required by law or as described in our Refund Policy.
You represent that purchases are for your own personal/household use and not for resale or redistribution.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout and in your confirmation email. Posted prices exclude taxes and any applicable charges unless stated otherwise.
You agree to provide current, complete, and accurate purchase and payment information and to promptly update your details so we can complete transactions and contact you as needed. You represent that you are authorized to use the payment method and that charges will be honored.
SECTION 5 – DIGITAL DELIVERY
For digital products, after payment is confirmed, download links or file access are provided via Shopify and/or our digital-delivery app. Delivery times may vary due to payment processing or technical factors.
If you experience any file issues (defective/corrupted/incorrect file), contact us within 7 days at adriana@tuinvite.com so we can repair, replace, or re-deliver the correct files.
If we ever offer physical items, title and risk of loss pass to you when we deliver items to the carrier; delivery times are estimates only.
SECTION 6 – LICENSE & INTELLECTUAL PROPERTY
All content on the Services—including templates, designs, text, graphics, images, logos, and files—is owned by Tu Invite or its licensors and is protected by U.S. and international IP laws.
License to You (Digital Products). Upon purchase, we grant you a personal, non-exclusive, non-transferable license to use the purchased digital files for your own personal, non-commercial use (e.g., using a template to create your own invitation). Unless a product page explicitly grants extended/commercial rights, you may not:

resell, sublicense, share, gift, or distribute the files or derivative files;

claim the designs as your own;

upload the files to any shared library or print-on-demand marketplace;

remove proprietary notices.
All rights not expressly granted are reserved by Tu Invite. Tu Invite names, logos, and product names are trademarks of Tu Invite. Shopify trademarks are owned by Shopify.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools (e.g., download apps, translation, design platforms such as Canva). These are provided “as is” and “as available” without warranties. Your use is at your own risk and subject to those providers’ terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain third-party materials or links. We are not responsible for their content or accuracy and are not liable for any harm from your use of third-party websites or purchases. Review third-party policies before engaging in transactions.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Tu Invite is powered by Shopify. However, all sales on our Store are made directly with Tu Invite. Shopify is not responsible for your purchases or any related claims. You expressly release Shopify and its affiliates from all claims arising from your transactions with Tu Invite.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy and may also be processed by Shopify under its privacy policy. Because the Services are hosted by Shopify, information you submit may be transmitted to Shopify and third parties (which may be located outside your country) to enable the Services. See our Privacy Policy for details.
EU Digital Content Notice. For EU/EEA customers: where you elect immediate download/access of digital content, you acknowledge that you lose the 14-day right of withdrawal once delivery begins. We may ask you to confirm this at checkout.
SECTION 11 – FEEDBACK
If you submit feedback, reviews, or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display such Feedback for any purpose. You represent you have the rights to provide it and that it complies with these Terms.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
We may correct errors or update information (including pricing and availability) without prior notice, including after you submit an order.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes. You agree not to engage in any prohibited conduct listed here, including violating laws, infringing IP, harassing others, transmitting malware, scraping, or circumventing security. We may suspend or terminate access for violations.
SECTION 14 – TERMINATION
We may terminate or suspend your access to the Services at any time, in our sole discretion, without notice. Sections intended to survive termination will continue to apply.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated by Tu Invite, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, or non-infringement). Some jurisdictions do not allow certain disclaimers; those limits may apply to you.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Tu Invite and its personnel and service providers (and Shopify and its affiliates) shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages, or for lost profits, revenue, data, or replacement costs, arising from your use of the Services or products, even if advised of the possibility.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Tu Invite (and Shopify) and their affiliates, officers, employees, and agents from claims, damages, and expenses arising from your breach of these Terms, violation of law, or misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision is unlawful or unenforceable, the remainder remains in effect to the fullest extent permitted by law.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce any right is not a waiver. These Terms, together with posted policies (including the Privacy Policy and Refund Policy), are the entire agreement between you and us regarding the Services.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without notice.
SECTION 21 – GOVERNING LAW
These Terms and any disputes relating to the Services are governed by the laws of the Commonwealth of Pennsylvania and applicable U.S. federal law. You and Tu Invite agree to the exclusive jurisdiction and venue of the state and federal courts located in Cumberland County, Pennsylvania, USA.

Headings are for convenience only and do not affect interpretation.

You can review the most current version of the Terms at any time on this page. We may update these Terms by posting changes here and, when required by law, by providing notice. Your continued use of the Services after changes take effect constitutes acceptance.
